Terms of sale

These terms are between you and My Prepack Cigars LLC of 10900 NW 21st St, Unit 230, Miami, FL 33172, trading as My Cigar Stash. Using this site or placing an order means you accept them. If you do not, do not order.

They work alongside our privacy policy, shipping policy, returns policy, and age verification policy, each of which forms part of this agreement.

You must be 21 years of age or older and buying for your own use. You must give your real name and a real address that matches the person paying. Buying on behalf of a minor, or reselling what you buy here, ends the relationship and may be a crime in your state.

Every order is age-verified, and an order that fails verification is cancelled and refunded in full. Passing the age gate on the front page is a courtesy check, not the verification.

An order you place is an offer to buy. The sale is made when we accept it and ship. Until then we may decline or cancel any order, in whole or in part, and refund you.

We describe and price everything as carefully as we can, but errors happen. If an item is listed at an obviously wrong price or with a wrong description, we will contact you before charging you and let you confirm or cancel. We do not honour pricing errors.

Allocated releases arrive in quantities the manufacturers decide. Stock shown may sell out between your order and our packing bench. If that happens we refund the line rather than substitute something else.

Sales tax, and any tobacco excise tax your state charges on remote purchases, is calculated at checkout and shown before you pay. Where we are not registered to collect a state's tobacco tax, checkout will say so and that state will not be available.

We ship from Florida by USPS and UPS. Restricted states, adult signature requirements, and the rules on lighters are set out in the shipping policy.

Title and risk of loss pass to you when the carrier takes the parcel. That said, we do not hide behind that clause: if a parcel arrives damaged or goes missing in transit, tell us within 7 days and we will make it right under the returns policy.

You are responsible for giving an address where an adult 21 or older can sign. Orders returned to us because nobody could sign are refunded less the shipping actually spent.

Cigars are not a safe alternative to cigarettes. Tobacco smoke increases the risk of lung cancer and heart disease, even in non-smokers. Cigar smoking can cause cancers of the mouth and throat, even if you do not inhale. Cigars contain nicotine, an addictive chemical.

California Proposition 65 warning: cigars and cigar smoke contain chemicals known to the State of California to cause cancer and birth defects or other reproductive harm.

The photographs, layout, and written copy on this site belong to us. Do not scrape or republish them.

Brand names, logos, and band artwork belong to their respective manufacturers. We are an independent retailer of genuine product and claim no affiliation with, or endorsement by, any manufacturer beyond being a buyer of what they make.

We promise the goods are genuine, stored properly, and match their description. Beyond that, and beyond the rights your state gives you that cannot be waived, the site and the goods are provided as they are. Taste is subjective and a cigar you did not enjoy is not a defective cigar.

As far as the law allows, our total liability for any order is limited to what you paid for it, and we are not liable for indirect or consequential loss. Nothing here limits liability for fraud, or for death or personal injury caused by our negligence.

These terms are governed by the law of the State of Florida, without regard to its conflict-of-laws rules. Any dispute is brought in the state or federal courts sitting in Miami-Dade County, Florida, and both of us consent to that venue.

We may revise these terms. The version in force for your order is the one published when you placed it, and the date at the top tells you when the current wording took effect.
